What the Service is

KOTN Price Tracker provides price history, statistics, and informational bid guidance related to lots on King of the North Auction (kotnauction.com).

We are not affiliated with, endorsed by, or partnered with King of the North Auction or its operators. KOTN is a separate third-party auction platform. The Service does not place bids for you and does not replace KOTN's own website, terms, or payment/pickup process.

Informational use only — not advice

History, medians, percentiles, "verdicts," alerts, and similar features are informational tools. They are not financial, investment, legal, or purchasing advice. Past auction results do not guarantee future prices. Matching lots across auctions can be imperfect. You alone decide whether and how much to bid on KOTN, and you alone are responsible for those decisions and any resulting purchase obligations.

Eligibility and accounts

• You must be legally able to enter a contract to use a paid plan.
• Provide accurate signup information and keep your password confidential.
• You are responsible for activity under your account.

Subscriptions and billing

Paid plans and any free trial are described on the website. Payments are processed by Stripe. Starting a paid subscription authorizes recurring charges until you cancel through the billing portal we provide (or as otherwise offered).

• Fees are generally non-refundable except where required by law or where we expressly agree otherwise.
• Prices are typically shown in CAD and may change; we will update the site or notify you as appropriate for material changes.

Acceptable use

You agree not to:

• Use the Service for unlawful purposes
• Scrape, copy, or redistribute our compiled history or product data at scale for a competing service
• Attempt to disrupt, reverse engineer, overload, or bypass the Service
• Abuse trials, billing, or shared accounts in bad faith

We may suspend or terminate access if we reasonably believe you have violated these terms or pose a security or legal risk.

Data accuracy and availability

We aim to keep history reasonably up to date, but we do not warrant that data is complete, current, or error-free. KOTN may change its site or listings at any time. We do not warrant uninterrupted access; features may change as the product evolves.

Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Apex Slice, Kayadevs, and their directors, officers, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, bidding losses, overpayment, missed lots, data loss, or business interruption, arising from your use of the Service — even if advised of the possibility.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the three (3) months before the claim, or (b) CAD $50.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum extent permitted by law.

Indemnity

You agree to defend and indemnify Apex Slice and Kayadevs against claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your bidding decisions on KOTN, your violation of these terms, or your violation of third-party rights — except to the extent caused by our willful misconduct.

Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or end access for breach, legal reasons, or if we discontinue the product. Survival clauses (liability, indemnity, governing law) remain in effect.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction over disputes, subject to any non-waivable consumer protections that apply to you.

Changes

We may update these terms from time to time. We will change the "Last updated" date above. Continued use after a change means you accept the updated terms.
